
REVOCATIONS FOR DRUG OFFENSES
Under 540 CMR 20.00, a person convicted of a drug offense will lose their license. The length of suspension is determined by the severity of the offense. A person must complete 50% of the license suspension to be considered for early reinstatement.
The suspensions fall into either a one, two, three or four year suspension. This list of suspension is not exhaustive, it includes but is not limited to the offenses listed below.
ONE YEAR SUSPENSION
- Possession of Class A Substance
- Possession of Class B Substance
- Possession of Class C Substance
- Possession of Class D Substance
- Possession of Class E Substance
- Conspiracy to Violate Controlled Substance Laws
TWO YEAR SUSPENSIONS
- Possession of Class D Substance w/ intent to Distribute
- Possession of Class E Substance w/ intent to Distribute
- Uttering a False Prescription
- Sale of Drug Paraphernalia to Minors
THREE YEAR SUSPENSIONS
- Possession of Class A Substance w/ intent to Distribute
- Possession of Class B Substance w/ intent to Distribute
- Possession of Class C Substance w/ intent to Distribute
- Second or subsequent Conviction of Possession of Class D
- Second or subsequent Conviction of Possession of Class E
FOUR YEAR SUSPENSION
- Second or subsequent Conviction of Possession of Class A with intent to Distribute
- Second or subsequent Conviction of Possession of Class B with intent to Distribute
- Second or subsequent Conviction of Possession of Class C with intent to Distribute
- Second or subsequent Conviction of Possession of Cocaine
FIVE YEAR SUSPENSIONS
- Trafficking of a Class A substance
- Trafficking of a Class B substance
- Trafficking of a Class D substance
- Unlawful Manufacturing and sales to minors of a Class A, B, or C substance
- Controlled substance in, on, or near School zone or property
